Terms of Service

These terms explain the rules for using Crewda and joining real-world hangouts through the app.

These Terms of Service ("Terms") govern the Crewda mobile application, website, and related services (the "Service") operated by Nikata Technologies Private Limited, India ("Crewda", "we", "us", or "our"). By creating an account, continuing through signup, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use Crewda.

1. What Crewda provides

Crewda is a local social platform for adults to host and join small-group lunch and dinner hangouts. The Service may include profiles, discovery, payments, chat, restaurant discovery and reservations, invitations, ratings, card games, safety tools, and promotional challenges.

Crewda organises access to the platform and facilitates connections and payments. Unless we expressly say otherwise, Crewda is not the restaurant, food seller, venue operator, transport provider, alcohol provider, employer, emergency service, or insurer. Restaurants and other third parties remain responsible for their own goods and services.

2. Eligibility and accounts

You must be at least 18 years old and legally capable of entering a contract. You must provide accurate, current information and use your own phone number and profile. You are responsible for your account, device, and activity.

A real profile image and profession are required before joining a paid hangout or requesting hosting rights. A detectable-face check on a profile image is only a basic photo-quality check, not proof of identity. Selfie verification is normally required to join and is required before an in-app hosting application. Crewda may separately review and directly approve a host without requiring that person to repeat selfie verification.

Do not impersonate anyone, operate deceptive duplicate accounts, share access, evade a block or suspension, or misstate your age, identity, profession, host status, attendance, or payment information.

3. Hangout format and visibility

New Crewda hangouts are lunch or dinner gatherings with a fixed table size of six, including the host. The Service may reserve seats by gender to support a minimum mixed-table composition. A displayed seat count or reservation is not a guarantee until the server confirms payment and membership.

Before joining, users are shown the host and broad area/city. Exact venue and other guest profiles are intended for joined participants. A host may initially provide only an area and must update the restaurant when required. Joined participants must not misuse, scrape, publish, or share another participant's personal details, exact venue, chat, or images without a lawful reason or permission.

4. Hosting rights and host responsibilities

Only Crewda-approved hosts may publish paid hangouts. Approval is discretionary and may be withdrawn for safety, quality, fraud, legal, or policy reasons. Hosting rights do not create employment, agency, partnership, franchise, or authority to bind Crewda.

Hosts must:

  • attend and lead the hangout honestly and respectfully;
  • select a lawful, public, reasonably safe restaurant where conversation can happen, and reserve an appropriately sized table before the hangout;
  • provide accurate area, venue, date, time, reservation name, cost, and booking status, and promptly update participants if allowed by the app;
  • use group chat responsibly to help participants feel comfortable before the hangout;
  • not discriminate, harass, pressure, mislead, exploit, or endanger guests;
  • give a truthful reason when removing a guest or cancelling a hangout; and
  • comply with restaurant rules, tax obligations, permits, and applicable law.

Seriously poor experiences, misleading reservations, no-shows, abusive conduct, or substantiated refund/safety reports may lead to payout holds, reduced or withheld payouts where legally permitted, cancellation, or loss of hosting rights.

5. Guest responsibilities and conduct

Guests must keep their profile accurate, pay the displayed organising fee, arrive responsibly, follow venue rules, pay their own restaurant bill and personal expenses, and treat hosts, guests, restaurant staff, and others respectfully.

Misbehaviour may be reported to Crewda and, where appropriate, authorities. Do not harass, threaten, stalk, touch without consent, discriminate, pressure anyone to drink or spend money, bring illegal items, promote illegal services, or use Crewda to facilitate violence, exploitation, trafficking, fraud, or other unlawful conduct.

Crewda's support and SOS shortcut is not an emergency service. In an immediate emergency, leave the location if safe and contact local emergency services or police.

6. Organising fees, restaurant costs, and payments

The host sets the organising fee per guest within Crewda's product limits. The restaurant bill, food, drinks, reservation or cover charges, transport, tips, and other personal expenses are separate unless the checkout clearly says otherwise.

Guest organising-fee payments are processed by Razorpay. Razorpay's checkout terms and payment-method rules also apply. A payment is complete only after Crewda verifies the provider confirmation and adds the guest to the hangout. If payment is captured but the seat or applicable reserved-gender capacity becomes unavailable, Crewda will initiate a refund to the original payment method.

Hosts receive the share shown in host tools or separately agreed with Crewda. Host earnings are estimates until the hangout has occurred and payments, cancellations, refunds, guest reports, chargebacks, taxes, and payout holds are resolved. Crewda currently sends approved host payouts manually using the private payout details supplied by the host. Hosts are responsible for accurate details and their own tax or reporting obligations.

Do not initiate a false chargeback, submit forged proof, manipulate payment status, or claim a refund for a hangout that occurred. We may provide transaction and attendance records to payment providers or authorities to contest fraud.

7. Cancellations, removals, refunds, and disputes

The cancellation and refund summary shown before payment forms part of these Terms.

  • If the host cancels a hangout through Crewda, or Crewda determines that the hangout did not occur, eligible guest organising-fee payments will be refunded to the original payment method.
  • If a guest voluntarily leaves, a refund is not guaranteed. The guest is generally eligible only if Crewda can fill the vacated place under the table and reserved-seat rules, as described at cancellation.
  • If a host removes a guest before the hangout starts, Crewda generally initiates a refund automatically. A removal after the scheduled start does not automatically qualify for a refund and may be reviewed through Write to Us.
  • A host may remove a seriously problematic guest while the hangout is in progress. A host may cancel the entire hangout only within the product's allowed cancellation window and should cancel only if the hangout did not or cannot happen.
  • If payment succeeds but Crewda cannot confirm the seat because of simultaneous payments or capacity rules, Crewda will initiate a refund.
  • Provider-accepted refunds are usually reflected within seven days, but the bank, card network, UPI provider, or Razorpay controls the final credit time.

Guests can report that a hangout did not happen. Crewda may hold host payout and challenge/rating progress while reviewing chat, location, booking, attendance, payment, and other relevant records. Crewda may request information from affected users and decide eligibility reasonably, subject to applicable consumer law.

Swiggy reservation charges and restaurant charges are separate third-party transactions. Their cancellation and refund rules are controlled by Swiggy or the restaurant, not by Crewda, unless the app expressly states otherwise.

8. Swiggy Dineout and other third-party services

Hosts may use Swiggy Dineout inside Crewda to search restaurants, view Swiggy-provided content, authenticate, reserve a table, and, where available, complete a paid reservation using Swiggy's flow. Swiggy controls restaurant data, availability, offers, booking charges, payment options, confirmation, and reservation fulfilment. Crewda does not guarantee that Swiggy information is complete or that a restaurant will honour inaccurate or changed information.

The Service also uses or links to Google Firebase/Google Cloud, Google Maps/Places, Google ML Kit, Meta, Razorpay, Instagram, UPI apps, app stores, and other providers. Their terms and privacy policies apply to their services. External links do not mean Crewda controls or endorses all external content.

9. User content, chat, ratings, and invitations

You retain ownership of content you submit. You grant Crewda a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical display, moderate, and show that content as needed to operate, secure, promote, and improve the Service. This licence ends when the content is deleted, except for cached, backup, legal, safety, or previously shared copies that reasonably need to remain.

You must have the right to upload or share all content. Do not post illegal, deceptive, hateful, sexually exploitative, violent, discriminatory, private, infringing, or abusive content. Crewda has zero tolerance for Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). Do not create, upload, request, distribute, or facilitate CSAE, CSAM, grooming, sextortion, trafficking, sexual content involving a minor, non-consensual intimate content, threats, doxxing, scams, illegal goods or services, or instructions facilitating serious harm.

Invitation cards may include host profile information and hangout area/city. Review an invitation before sharing it. Do not edit or present it in a way that misrepresents Crewda, Swiggy, the host, venue, price, participants, or availability.

Ratings must reflect a genuine attended hangout and must not be manipulated, exchanged for benefits, or used to harass. Card-game prompts are optional; do not pressure anyone to answer.

10. Moderation, reporting, and blocking

Crewda may use automated checks and human review to moderate profiles, hangouts, messages, images, ratings, reports, and related activity. Users can report content or people and block users through available in-app tools. We may remove content, restrict discovery or chat, cancel a hangout, remove or block users, suspend hosting rights, hold payouts, preserve evidence, disable accounts, or contact authorities where reasonably necessary.

We aim to review safety and policy reports promptly, but cannot monitor every interaction in advance. We remove and report confirmed CSAM or other illegal content as required by applicable law. In an emergency, contact local emergency services.

11. The 10 Meal Challenge and promotions

Challenge progress, badges, event access, shields, gift hampers, and other promotional benefits may require verified completion of eligible, non-cancelled hangouts. Benefits are subject to availability, eligibility checks, stated promotion rules, and law. They have no cash value unless Crewda expressly states otherwise. Crewda may correct fraudulent or mistaken progress and may change or end a promotion prospectively.

12. Safety and real-world risk

Meeting people in person involves risk. Verification, host approval, ratings, profile checks, restaurant reservations, or a Crewda badge do not guarantee identity, background, conduct, compatibility, food safety, venue safety, or attendance. Use judgment, keep others informed of your plans, protect your belongings and personal information, arrange safe transport, and leave if you feel unsafe.

To the extent permitted by law, users are responsible for their own decisions and interactions. Nothing in these Terms excludes any duty or consumer right that cannot legally be excluded.

13. Intellectual property

Crewda's software, design, trademarks, branding, and original content are owned by Crewda or its licensors. Swiggy, Razorpay, Google, Meta, Instagram, Apple, and other names and marks belong to their respective owners. Do not copy, reverse engineer, scrape, sell, sublicense, or misuse the Service or branding except as law permits or with written permission.

14. Suspension, termination, and account deletion

You may stop using the Service and request deletion at any time. We may restrict, suspend, or terminate access for a breach, safety risk, fraud, non-payment, legal request, abusive conduct, repeated complaints, technical risk, or discontinued Service. Where practical and lawful, we will provide notice or a way to contact support.

Account deletion is available in Profile → Delete account and at https://crewda.in/requestdelete/. Deletion and legally required retention are described in the Privacy Policy. Outstanding refunds, payouts, disputes, safety investigations, or legal obligations may need to be resolved or retained after access ends.

15. Disclaimers and limitation of liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Crewda disclaims implied warranties and does not guarantee uninterrupted operation, a minimum number or particular mix of guests, host or guest conduct, restaurant availability, attendance, compatibility, or a specific social or professional outcome.

To the maximum extent permitted by law, Crewda is not liable for indirect, incidental, special, exemplary, or consequential loss. For a claim directly related to a paid Crewda transaction, Crewda's aggregate liability will not exceed the organising fees paid to Crewda by that user in the twelve months before the event giving rise to the claim. These limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or rights and liabilities that applicable law does not allow us to exclude or limit.

You are responsible for loss caused by your unlawful conduct, content, fraud, or material breach and will reimburse Crewda for third-party claims to the extent permitted by applicable law and fairly attributable to your actions.

16. Governing law and disputes

These Terms are governed by the laws of India, without taking away mandatory consumer protections that apply where you live. Before filing a claim, please contact hello@crewda.in so we can try to resolve it. Courts with jurisdiction under applicable law may hear unresolved disputes.

17. Changes and general terms

We may update these Terms as the Service or law changes. We will publish a new effective date and provide additional notice where required. Material changes apply prospectively unless law permits otherwise. If any provision is unenforceable, the remaining provisions remain effective. A delay in enforcement is not a waiver. You may not transfer your account or these Terms without our consent; Crewda may transfer them as part of a lawful business reorganisation.
