These Terms of Service (“Terms”) govern your use of the Crewda mobile application and related services (the “Service”) operated by Nikata Technologies Private Limited, India, under the Crewda brand (“Crewda”, “we”, “us”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Crewda helps you discover and join real-world group meetups (“crews”), chat with other participants, manage your profile, and use related social features we make available. Some crew/meet cover images may be generated by AI or image-generation providers from the crew activity/theme. Those images are for representational purposes only and may not show the actual participants, host, venue, or exact activity scene. We may add, change, or remove features at any time.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
3. Your Account
You are responsible for activity under your account and for keeping your device secure. You must not share your account in a way that allows others to impersonate you. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.
4. Acceptable Use
You agree not to:
- Harass, threaten, defame, or harm other users, or upload content that is illegal, hateful, sexually exploitative, violent, discriminatory, or involves child sexual abuse and exploitation (CSAE) or child sexual abuse material (CSAM).
- Create, host, join, promote, or coordinate crews for illegal, abusive, exploitative, harassing, hateful, violent, unsafe, discriminatory, or sexually inappropriate purposes.
- Create, upload, share, request, or promote child sexual abuse or exploitation material, sexual content involving minors, human trafficking, non-consensual sexual content, illegal goods or services, fraud, scams, threats, stalking, doxxing, self-harm instructions, weapons misuse, or other unlawful conduct.
- Use Crewda or any crew to abuse, bully, exploit, intimidate, target, or endanger another person.
- Impersonate any person or entity, or misrepresent your affiliation.
- Use AI-generated crew images or other content to mislead users about the actual host, participants, venue, safety, cost, availability, or nature of a crew.
- Spam, scrape, or use automated means to access the Service in a way that overloads or circumvents intended use.
- Attempt to reverse engineer, bypass security, or access data that does not belong to you.
- Use the Service for any unlawful purpose or in violation of applicable laws.
UGC checks and enforcement: We may run best-effort automated checks and manual review on profiles, crew titles/descriptions, chats, reports, and related activity. We may remove content, cancel or restrict crews, block joins, expel users from crews, hide blocked users/content, preserve safety records, suspend or terminate accounts, and report matters to law enforcement or regulators when we believe it is necessary for safety, legal compliance, child safety, or the integrity of the Service. 5. User Content
You retain rights to content you submit. By submitting content, you grant us a worldwide, non-exclusive licence to host, store, reproduce, display, and distribute that content solely to operate and improve the Service. You are responsible for ensuring you have the rights to any content you upload, and that your content and crews comply with these Terms.
Crew/meet cover images generated by Crewda or its providers are illustrative only. They are not a promise, verification, or representation that the shown people, venue, activity, safety conditions, or event details are real or exact.
6. Crews, Location, and Real-World Meetings
Crews involve meeting people in person. You are solely responsible for your safety and choices when attending meetups. Crewda does not guarantee the behaviour of other users or the safety of any location. Use good judgment, meet in public places when appropriate, and follow local laws.
You must not create, join, or use crews for illegal activity, abuse, harassment, exploitation, violence, unsafe conduct, or any purpose that violates these Terms or applicable law.
7. Intellectual Property
The Service, including its design, branding, and software, is owned by us or our licensors. You may not copy, modify, or create derivative works except as allowed by law or with our written permission.
8. Third-Party Services
The Service may integrate third-party services—including Google Firebase / Google Cloud, Firebase Authentication, Firebase Analytics, Flutter ML Kit plugins built on Google ML Kit, AI/image-generation providers for representative crew images, maps or deeplink providers, and infrastructure bundled via Flutter plugins. Their use is subject to those third parties’ terms and privacy policies.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, we and our affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim or (b) zero if the Service is free.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
11. Indemnity
You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, create or participate in abusive or illegal crews, misuse UGC features, or for operational, legal, or security reasons. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.
13. Changes to the Terms
We may modify these Terms from time to time. We will post the updated Terms in the app and update the effective date. Continued use after changes constitutes acceptance, where permitted by law. If you do not agree, you must stop using the Service.
14. Governing Law
These Terms are governed by the laws applicable in your primary place of residence or, where we specify otherwise for our entity, by the laws we designate in a future update, without regard to conflict-of-law rules. Courts in the appropriate jurisdiction shall have exclusive jurisdiction, subject to mandatory consumer protections in your country.
